Terms and Conditions
Welcome to the 12 Trees Stewardship Training.
These Terms and Conditions apply to your participation in the 12 Trees Stewardship Training (“Training”) provided by Twelve Trees Integration LTD, trading as ACER Integration (“we”, “us”, “our” or “ACER Integration”).
The Training is an 18-month programme designed to support participants in developing the knowledge, embodied understanding, practical skills and stewardship required to work with the 12 Trees framework in community and other appropriate settings.
Please read these Terms carefully before enrolling. By applying for and accepting a place on the Training, you confirm that you have read, understood and agree to these Terms.
These Terms should be read alongside any additional programme information, participant agreements, safeguarding policies, codes of conduct, licensing terms and other policies provided to you as part of the Training (“Service Terms”). Where there is any inconsistency between these Terms and a specific Service Term relating to the Training, the specific Service Term will apply.
1. About the Training
1.1. The 12 Trees Stewardship Training is an 18-month educational and experiential training programme.
1.2. The Training includes participation in the ACER Integration community for the period specified as part of your Training enrolment.
1.3. Participation in ACER Integration forms an integral part of the Training. Participants are expected to engage with the ACER community, materials, practices and learning environment as part of their development as a prospective 12 Trees Steward.
1.4. The Training may include, but is not limited to, live teaching, experiential learning, group sessions, community participation, written or practical work, reflective practice, assignments, demonstrations, facilitated practice, feedback, observation and other forms of assessment.
1.5. The precise format, structure, schedule and content of the Training may be amended where reasonably necessary. We reserve the right to make reasonable changes to the Training, including its delivery format, teaching schedule, facilitators, materials and methods of assessment.
1.6. The Training is educational in nature. Participation does not constitute medical, psychological or therapeutic treatment, nor does participation create a therapist, coaching or other professional relationship between you and ACER Integration.
2. Application and Acceptance
2.1. Applicants are required to complete an application process. Acceptance onto the Training is at the discretion of ACER Integration.
2.2. We reserve the right to decline an application where, in our reasonable judgement, the Training is not suitable for the applicant or where the applicant does not meet the requirements for participation.
2.3. Acceptance onto the Training does not constitute a guarantee that you will successfully complete the Training, graduate as a 12 Trees Steward or receive a licence to use the 12 Trees materials.
2.4. By accepting a place, you acknowledge that the Training involves ongoing participation, learning and assessment and that successful completion depends on your engagement with the full requirements of the programme.
3. Training Assessment and Graduation
3.1. The 12 Trees Stewardship Training is subject to ongoing assessment.
3.2. Assessment may take place throughout the full 18-month programme and may include attendance, participation, engagement with the community, completion of required learning, reflective work, practical work, demonstrations of competency, facilitated practice, responsiveness to feedback and other criteria communicated to participants.
3.3. Participants are required to complete all elements of the Training that are identified as compulsory.
3.4. Completion of the 18-month period does not, by itself, constitute successful completion of the Training.
3.5. ACER Integration does not guarantee that any participant will pass or graduate from the Training.
3.6. A participant may be assessed as not having successfully completed the Training where they have not demonstrated the required level of understanding, competency, participation, conduct or completion of required elements.
3.7. Where appropriate, ACER Integration may provide feedback regarding areas in which a participant has not met the requirements of the Training. Any opportunity to undertake additional work, demonstrate competency again or otherwise address outstanding requirements is at the discretion of ACER Integration and is not guaranteed.
3.8. The decision as to whether a participant has successfully completed the Training and is eligible to graduate as a 12 Trees Steward rests with ACER Integration.
3.9. Successful graduation from the Training is a prerequisite for receiving a 12 Trees materials licence.
3.10. A participant who does not successfully complete the Training is not entitled to receive a 12 Trees materials licence.
4. No Refund for Non-Completion or Non-Graduation
4.1. By enrolling in the Training, you acknowledge that successful completion and graduation are not guaranteed.
4.2. The Training fee covers participation in the programme and access to the Training during the agreed programme period. It does not constitute payment for a guaranteed qualification, graduation outcome or licence.
4.3. Failure to pass, graduate or complete the Training is not grounds for a refund of fees already paid.
4.4. This includes circumstances where a participant:
a. does not meet the assessment requirements;
b. does not complete required elements of the Training;
c. does not attend sufficient sessions or activities;
d. does not demonstrate the required competencies;
e. does not respond adequately to feedback;
f. chooses to discontinue participation;
g. is unable or unwilling to complete the Training requirements; or
h. is assessed as unsuitable for graduation.
4.5. Nothing in this section affects any statutory consumer rights that cannot lawfully be excluded or limited.
5. Payment and Programme Commitment
5.1. The 12 Trees Stewardship Training is sold as a single 18-month programme.
5.2. The Training fee is the fee communicated to you at the time of enrolment and confirmed in your enrolment or payment documentation.
5.3. Payment may be made as a single payment or through an agreed payment plan where this option is offered.
5.4. Where a payment plan is agreed, the payment plan is a method of paying for the full 18-month Training commitment. It does not create a series of separate short term memberships or allow you to cancel future payments simply by discontinuing participation.
5.5. If you choose an instalment plan, each scheduled payment remains due in accordance with the agreed payment schedule.
5.6. Failure to make an instalment does not automatically release you from your obligation to pay any remaining amounts due under the agreed Training payment plan.
5.7. All fees are quoted and charged in pounds sterling (£ GBP) unless otherwise stated.
5.8. Where applicable, VAT will be charged in accordance with the law.
6. ACER Community Membership
6.1. The Training includes access to the ACER Integration community for the period specified as part of the Training.
6.2. ACER community participation is included as an integral component of the 18-month Training programme and is not a separate short-term membership purchased independently during this period.
6.3. Participants who wish to remain members of the ACER Integration community after their included Training period has ended will need to purchase continued ACER membership at the applicable membership rate at that time.
6.4. Continued ACER membership after the included period is not included in the Training fee.
6.5. Any continued membership will be subject to the ACER Integration Terms and Conditions and the membership terms and pricing applicable at the time of renewal.
6.6. Continuing as an ACER community member after completion of the Training does not guarantee graduation from the 12 Trees Stewardship Training and does not confer any right to use the 12 Trees materials.
7. Cooling Off Period and Cancellation
7.1. If you are a consumer within the UK, you may have a statutory right to cancel your purchase within the applicable cooling-off period.
7.2. Where applicable, you may request a refund within 14 days of the initial purchase, subject to applicable consumer law and the circumstances in which access to digital content or services has commenced.
7.3. Where you have expressly requested that the Training or digital content begin during the cooling-off period, your statutory cancellation rights may be affected to the extent permitted by law.
7.4. Requests for cancellation must be submitted in writing via email to connect@acerintegration.com and finance@acerintegration.com
7.5. Subject to any statutory cancellation rights, fees paid for the Training are non-refundable.
7.6. Voluntary withdrawal from the Training does not create an entitlement to a refund.
7.7. Withdrawal from the Training does not automatically cancel any outstanding payment obligations under an agreed payment plan.
8. Deferral
8.1. ACER Integration may, at its discretion, permit a participant to defer participation in exceptional or extenuating circumstances.
8.2. Requests for deferral must be made in writing to connect@acerintegration.com and should normally be made as soon as reasonably possible after the circumstances arise.
8.3. A deferral is not guaranteed and remains subject to ACER Integration's assessment of the circumstances and the availability of an appropriate future Training opportunity.
8.4. A deferral may be subject to additional terms, conditions or fees.
8.5. A deferral does not constitute a refund or cancellation of the Training agreement.
9. Successful Graduation and 12 Trees Licence
9.1. Successful completion and graduation from the 12 Trees Stewardship Training does not automatically grant unrestricted ownership or use of the 12 Trees materials.
9.2. The 12 Trees framework, materials, teaching resources, written materials, recordings, exercises, diagrams, language, concepts and other associated intellectual property remain the property of ACER Integration and/or their respective rights holders.
9.3. Following successful graduation, a participant may be offered a licence to use specified 12 Trees materials in accordance with the applicable licensing terms.
9.4. The standard post-training licence fee is £600 per year.
9.5. The £600 annual licence fee is separate from and additional to the Training fee.
9.6. The licence fee is not payable unless and until a participant has successfully graduated and is eligible to receive the relevant licence.
9.7. Payment of the annual licence fee grants only the rights expressly provided under the applicable 12 Trees licence agreement. It does not transfer ownership of the 12 Trees intellectual property to the participant.
9.8. The licence must be renewed annually if the participant wishes to continue using the licensed materials beyond the applicable licence period.
9.9. ACER Integration reserves the right to update the licensing terms and fee structure for future renewal periods, giving reasonable notice where appropriate.
9.10. A participant who has not successfully graduated from the Training may not represent themselves as a 12 Trees Steward or use the 12 Trees materials in a manner that suggests they have been authorised or licensed to do so.
10. Intellectual Property
10.1. All content included in or made available through the Training, including but not limited to teaching materials, videos, recordings, documents, written materials, exercises, diagrams, presentations, logos, names, frameworks and other resources, is owned by ACER Integration or its content suppliers unless otherwise stated.
10.2. Participation in the Training does not transfer ownership of any intellectual property to you.
10.3. Unless expressly permitted in writing, you must not reproduce, copy, modify, adapt, distribute, publish, sell, licence, sub licence, broadcast, publicly perform, commercially exploit or create derivative works from Training materials.
10.4. You must not share Training materials with people who are not authorised participants.
10.5. You must not upload Training materials to public websites, social media, file sharing services, artificial intelligence systems or other third party platforms without prior written permission.
10.6. Any permission to use 12 Trees materials following graduation is governed exclusively by the applicable licence agreement.
11. Use of the 12 Trees Name and Framework
11.1. The 12 Trees name, framework, materials and associated intellectual property may only be used in accordance with the permissions granted by ACER Integration.
11.2. Successful completion of the Training does not give you permission to reproduce or teach the Training itself.
11.3. You may not present yourself as authorised to train, certify or assess other 12 Trees Stewards unless ACER Integration has expressly granted you that authority in writing.
11.4. You may not create your own certification, accreditation or training programme based on the 12 Trees framework without prior written permission.
11.5. Any use of the 12 Trees materials in professional, commercial, educational or community settings must comply with the applicable licence.
12. Participant Responsibilities
12.1. You are responsible for engaging with the Training in a manner that supports your own wellbeing and the wellbeing of other participants.
12.2. You agree to comply with all safeguarding policies, community guidelines, codes of conduct and other Service Terms provided to you.
12.3. You agree to participate respectfully and to maintain appropriate confidentiality regarding personal information shared by other participants.
12.4. You must not record, reproduce or distribute sessions or participant contributions unless expressly permitted.
12.5. You are responsible for ensuring that you have the technology, internet access and equipment reasonably required to participate in online elements of the Training.
13. Safeguarding and Community Conduct
13.1. ACER Integration is committed to creating spaces that are respectful, inclusive and appropriately safeguarded.
13.2. We reserve the right to investigate concerns relating to participant conduct.
13.3. We may suspend or terminate a participant's access to the Training or community where we reasonably believe their behaviour is unsafe, disruptive, discriminatory, abusive, harassing or otherwise inconsistent with our safeguarding policies or code of conduct.
13.4. Removal from the Training or community for conduct related reasons does not create an entitlement to a refund of fees already paid.
13.5. Where appropriate, we may provide reasonable notice of a concern and an opportunity to respond, although this will not always be possible or appropriate where safeguarding or other serious concerns arise.
14. Health and Wellbeing
14.1. The Training is educational and experiential in nature and is not a substitute for medical, psychological or therapeutic care.
14.2. You remain responsible for your own health, wellbeing and decisions regarding participation.
14.3. You should seek appropriate professional advice regarding any health condition or circumstance that may affect your ability to participate safely.
14.4. You are responsible for communicating relevant limitations or needs to ACER Integration where appropriate.
14.5. ACER Integration does not guarantee any particular personal, professional, therapeutic or other outcome from participation in the Training.
15. No Guarantee of Professional Outcome
15.1. The Training is designed to develop knowledge, skills and understanding relating to stewardship of the 12 Trees framework.
15.2. Successful completion does not guarantee employment, clients, income, professional recognition, accreditation by any external body or any particular professional outcome.
15.3. Participants remain responsible for ensuring that their use of the Training and any subsequent practice complies with all applicable laws, professional standards, insurance requirements and other requirements relevant to their own professional context.
16. Access to Training Materials
16.1. Access to Training materials is provided for the duration and purposes of the Training unless otherwise stated.
16.2. If your participation is terminated or you withdraw from the Training, your access to Training materials and community spaces may be withdrawn.
16.3. Where access is withdrawn, you must cease using any Training materials that you are no longer authorised to access or use.
17. Limitation of Liability
17.1. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot lawfully be excluded or limited under English law.
17.2. Subject to section 17.1, ACER Integration will not be liable for indirect, incidental, special or consequential loss arising from participation in or inability to participate in the Training, to the extent permitted by law.
17.3. We are not responsible for losses arising from circumstances outside our reasonable control.
17.4. Nothing in these Terms limits or removes any statutory rights you have as a consumer that cannot lawfully be excluded.
18. Changes to the Training
18.1. We reserve the right to make reasonable changes to the Training where necessary.
18.2. This may include changes to dates, schedules, facilitators, teaching methods, delivery formats, materials or programme structure.
18.3. Where a significant change materially affects the Training, we will provide reasonable notice where practicable.
19. Termination by ACER Integration
19.1. We may suspend or terminate your participation in the Training where you materially breach these Terms or any applicable Service Terms.
19.2. We may also suspend or terminate participation where there are serious safeguarding, conduct, payment or other legitimate concerns.
19.3. Where the circumstances permit, we may provide you with notice of the issue and an opportunity to address it.
19.4. Termination by ACER Integration as a result of a participant's breach of these Terms does not entitle the participant to a refund of fees already paid.
19.5. Any outstanding payment obligations will remain payable where permitted by law and the terms of the applicable payment agreement.
20. Privacy
20.1. We will process your personal information in accordance with our Privacy Policy.
20.2. By participating in the Training, you acknowledge that certain personal information may need to be processed by third party providers used to deliver the Training, including community, payment, video conferencing and other service providers.
21. Confidentiality
21.1. Participants may share personal, professional or otherwise confidential information during the Training.
21.2. You agree to respect the confidentiality and privacy of other participants and not to share identifiable personal information about other participants outside the Training without their consent.
21.3. Confidentiality does not apply where disclosure is required by law or where disclosure is necessary to address a safeguarding or serious safety concern.
22. Changes to These Terms
22.1. We reserve the right to update these Terms where reasonably necessary.
22.2. Where changes materially affect your rights or obligations during an active Training programme, we will provide reasonable notice where practicable.
22.3. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
23. Governing Law
23.1. These Terms and the agreement between you and ACER Integration are governed by the law of England and Wales.
23.2. The courts of England and Wales will have non exclusive jurisdiction over disputes arising from or in connection with these Terms, subject to any mandatory consumer rights that apply to you.
